This property came up at an auction last year. The lien being sold was about $2000 but there was already $14,000 of outstanding tax liens on the property. The county didn’t have online records and the buyer of the lien clearly didn’t do their homework. Would you pay $16,000 for that?

Comian XII Tax Lien Fund, LLC (the “Fund”) is a Delaware Limited Liability Company that was formed to invest in tax lien certificates where the collateral is real property. The tax lien certificates will be selected by the Fund Manager, Comian Investment Group (the “Manager”). The Manager will evaluate and allocate investments and be responsible for the day-to-day operations. The principal of the Manager is Katherine Dougherty, who has extensive experience in tax lien investing, portfolio management and real estate investment and management.

The Fund’s business strategy is to maximize and compound current income with the goal of generating a minimum of net double-digit returns to investors while also providing for future speculation and the possibility of limitless returns through investments in tax lien certificates. The Fund expects to make a significant portion of its investments by purchasing tax lien certificates on residential, commercial and unimproved properties through out the United States. After the applicable statutory waiting periods, the Fund will apply for tax deeds or foreclose upon properties allowing the investors to participate in the net profits generated from the sale of real properties acquired by the Fund.

Plan of Operation of Tax Lien Fund (Schedule of Members’ Return on Investment)

Our tax lien certificate investments will generate an uncertain stream of principal and interest payments. As such, we have derived the following Plan of Operation for the Fund:

  • Inception – Year 3: Fund Manager continues to reinvest principal and income into tax lien certificates, and, though highly doubtful, if deemed appropriate: short-term private mortgage instruments.
  • Year 3: Fund Manager begins tax deed and tax sale application processes for existing tax liens and certificates. Interest and Principal repayments received in Year 3 will cease to be reinvested in new holdings, instead Interest and Principal repayments will be used to cover the expenses associated with forcing outstanding holdings to tax sales or remittance (interest is still earned during this process). Any real properties gained will be sold and any profits will be captured by and among members in respect to Units owned.
  • Year 4-5: Principal and Income payments for any and all certificates, liens and mortgages will be disbursed annually to investors and/or their custodians after any funds needed to continue the tax sale or foreclosure process on properties or capital holdings have been allocated. Any real properties will be sold and gains on said property will be distributed among members in respect to their ownership Units.
  • Year 6: Any remaining property is liquidated, final disbursements will be made and Comian XII Tax Lien Fund, LLC will cease operations.
 
Tax Lien Market Overview
County governments issue tax lien certificates when a taxpayer becomes delinquent in making tax payments. The purchaser of the lien essentially steps in and pays the taxes so the county can continue funding to various programs. In exchange the county places a first priority lien on the property and interest accrues to the lien holder. If the property owner pays the taxes or if the property is sold, the lien is redeemed and the lien holder receives their principal and interest payment. Interest rates on liens yield between 8-25% on tax liens!  And if, after the required redemption period, the lien has not been redeemed the lien holder can apply for a tax deed or tax sale to try to obtain title to the property.
 
Investment Highlights

Following are some of the outstanding features and benefits enjoyed by Comian Tax Lien Fund investors:

  • Accredited Investors. All but 35 Investors per Comian Fund must be Accredited.
  • Safety. Tax Liens carry a priority over all other liens secured by the property including the first mortgage. Some exceptions apply to federal and state income tax liens, but because CIG searches for these when performing due diligence, this risk is reduced greatly.
  • Diversification. Comian Funds invest in many different liens on many different properties in many different locations. We diversify by end use of property and values and no one lien will ever exceed 5% of the market value of the respective Fund.

  • Monthly Statements. Statements of Accounts are provided to investors showing a variety of performance and statistical information.
  • Minimum Investment. The minimum investment in Comian Tax Lien Funds begins at $25,000.
  • Benefits of a Close-Ended Fund. Any investment in liens that converts to real property of a Comian Fund is securely divided by investors in relative percentage to their ownership. This assures each investor their rights to a percentage of profit from sale of any real property will not be diluted by a later investor.
  • Use of Funds and Reserve Account. 99% of investor capital goes to the Fund for investment in Tax Liens.
  • Low Management Fees. Comian Investment Group (CIG), Manager of Comian Funds, is paid by the Fund a 3.5% annual management fee and a bonus for net profits on properties deeded to the Funds.  Our Managers' performance over history had provided double-digit returns to investors. 
  • Investment Vehicles Other than Cash. Self-directed traditional IRAs, Roth IRAs, other qualified retirement accounts, health savings accounts, Coverdell education savings accounts and Trusts may invest in Comian Tax Lien Funds. Our Funds work with several national IRA trust and administration companies (link to SD IRA provider page) and are easily approved through others with simple paperwork that we will happily assist you with.
  • Experienced Management and Track Record.
